Terms & Conditions

The KUBO’s Winter Wonderland Competition (“Giveaway”) is organized by:

By entering this  Giveaway, you will be bound by these Terms & Conditions.. You also acknowledge that you satisfy all eligibility requirements. 

The competition starts December 13, 2022 at 12:00:00 PM EST and ends December 31, 2022 at 11:59:59 PM EST (the “Promotion Period”).

 

 

 

By entering the Giveaway you accept the following terms and conditions.

  • Eligibility

The Giveaway is open to all teachers employed by a school which is willing and able to accept or already has accepted the terms of use, terms of trade and privacy policy of the KUBO School portal and the KUBO subscriptions.

The Giveaway is open internationally.

 

Teachers are entering the Giveaway on behalf of a school. 

Eventually won prizes are awarded to the school, not the teacher personally.

The entering school is specified by the teacher on the entry form.

 

It is possible for multiple teachers to enter the Giveaway on behalf of the same school. Such entries will be treated individually and will therefore increase that school’s chances of winning.

  • Participation

To participate, the participants need to complete the following tasks: 

  • You must at least complete the first level of KUBO’s Winter Wonderland Competition
  • You must submit your name, a valid email and the name of the school you work at by 11:59:59 PM EST on December 31, 2022. 
  • Completing additional levels of the KUBO’s Winter Wonderland Competition does not grant the participant additional entries to the Giveaway. 

 

KUBO’s Winter Wonderland Competition consists of four (4) levels. There is a limit of one (1) entry per participant during the Promotion Period. Additional entries will be disqualified. KUBO reserves the right to disqualify any person that submits multiple entries. Automated or bulk entries submitted by third parties will be disqualified. Incomplete, illegible, incorrectly addressed, or late entries will not be accepted.

 

Purchase requirements

There is no requirement for the purchase of any goods or service offered by KUBO or any third company affiliated with either of the aforementioned, and/or any of their business partners. Purchase of any such good or service does not increase the participant’s chances in this Giveaway.

  • Winner selection

A total of one (1) prize (the “Prize”) will be selected in a random drawing.  The drawing for the Prize will be held on January 4, 2023. The drawing will be from all eligible entries received throughout the Promotion Period.

 

The winner will be contacted directly via the email they have used to sign up for the Giveaway. Winners will be contacted on January 5, 2023.

  • Prizes

The Prize includes the following: 

  • A digital subscription to KUBO Play for the period of one (1) year. 
  • Access to KUBO Play to all the teachers of the school that is granted the Prize 
  • 500 student licenses for KUBO Play to students of the school that is granted the Prize
  • Access to the KUBO Expansions – KUBO Coding + and KUBO Coding ++
  • Free on-boarding session with a KUBO Expert

 

The Prize is  valued at $2178. 

The Prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.

  • Delivery 

 

The Prize will be sent via email, once the winner has confirmed that they accept the prize. 

 

The winner must contact KUBO no later than 7 days after receiving an email that they have won. 

 

Obligations of the winner: 

  • Confirm their prize in accordance with the instructions contained in the Prize email
  • Confirm that they accept the Prize
  • Provide KUBO with the requested information
  • Accept the terms of use, terms of trade and privacy policy of the KUBO School portal and the KUBO subscriptions.

 

If the contacted winner does not respond to the email sent by KUBO within 7 days or is otherwise disqualified, their claim to the prize will be forfeited.

 

Current KUBO subscribers will have the option for a free renewal, at the end of their subscription period.

  • Marketing material

By entering the Giveaway the teacher accepts to receive marketing material from and be contacted by KUBO.

By entering the Giveaway the teacher accepts, on behalf of the specified school, to receive marketing material from and be contacted by KUBO.

  • Privacy policy

The teacher must accept KUBO’s privacy policy. 

KUBO’s privacy does apply to all informations collected and processed conjunction with the Giveaway, including but not limited to names, email addresses, names of schools/employer, phone numbers, access to KUBO products.

 

The winning teacher’s name and school will be posted on KUBO’s social media profiles after the winner has accepted the price. 

  • Liability

The participant is not guaranteed to win by entering the Giveaway. 

KUBO is not liable for any outer or inner adverse influence that might alter an individual participant’s chances of winning the Giveaway.

 

According to KUBO‘s knowledge, none of the Trademarks, other Intellectual Property Rights relating to its Products, or its Products constitute an infringement of third party intellectual property rights. However, KUBO does not warrant this.

  • Law and jurisdiction

These terms and any non-contractual obligations arising in connection with it are governed by and construed in accordance with Danish Law.  The United Nations Convention on Contracts for the International Sale of Goods does not apply.

 

Good faith negotiations. 

If a dispute arises out of or in connection with these terms, including any dispute concerning the existence or validity of these terms, the parties must undertake good faith negotiations and use their reasonable endeavours to resolve the dispute within 60 days of it arising. 

 

Arbitration 

The disputing parties agree that, if a dispute is not resolved within 60 days of it arising, either party may refer that dispute to arbitration by giving notice in writing to the other. 

The arbitration shall be administered by The Danish Institute of Arbitration in accordance with the rules of arbitration procedure adopted by The Danish Institute of Arbitration and in force at the time when such proceedings are commenced. www.voldgiftsinstituttet.dk/en

 

Any arbitration under this clause must be conducted by a single arbitrator: 

 

(a) agreed by the parties within 7 days after notice of referral to arbitration is given by a party; or 

(b) failing agreement, appointed by Voldgiftsinstituttet in Copenhagen Denmark. 

The seat of the arbitration will be Copenhagen, Denmark and the proper law of the arbitration will be the laws of Denmark.  

 

Urgent relief 

Nothing in clause prejudices the right of a party to seek urgent injunctive or declaratory relief for any matter in connection with these terms.
